- Must not have long term jail sentences
- Must not have holds or warrants, including immigration holds
- Must not have any other cases pending
- Must not have previously participated in a DUI Court program
- Must be a Yakima County case
- Must be a misdemeanor DUI case
Criminal History
The defendant may have any number of prior misdemeanor convictions but no more than 3 prior felony convictions entered on separate dates, except:
- Must not have a conviction for a class A felony
- Must not have a conviction for a prior “sex offense” (including allegation of sexual motivation)
- Must not have a conviction for a prior “violent” felony offense as dividend by RCW 9.94A.030(53) which includes convictions for Vehicular Homicide/Vehicular Assault
- Must not have a felony conviction for a firearm offense or any conviction with a firearm enhancement or where the offense resulting in a conviction that has a firearm as an element
- Must not have a felony conviction for Assault in the 3rd Degree unless certificate of discharge has been issued
- Must not have a domestic violence conviction within the past 3 calendar years unless agreed by the parties
